can i open a business credit card w/o owning a business?

i get these preapproved apps all the time in the mail for business c-cards. i wanna just open this 1 united card 2 get the miles but is it legal; i mean whats involved in the app process that would disprove me a business owner? does any 1 wk in the CC industry that can answer this? y am i gettin these business CC apps anyways?
